Attorneys for Irina Malinovskaya, the Wharton undergraduate accused of killing her ex-lover's girlfriend in 2004, have filed motions to have the case dismissed.
Malinovskaya has faced three trials in the case, all of which have ended in hung juries.
Delaware state prosecutors have not said if they will seek a fourth trial. While another trial would be unusual, there is no limit to the number of retrials the state can pursue.
At a status conference Friday, Delaware Superior Court Judge James Vaughn allowed one defense lawyer, Joe Hurley, to be dismissed from the case, The News Journal, of Wilmington, Del., reported.
Vaughn has not ruled on the motions to dismiss the case.
According to The News Journal, the defense withdrew a motion for a venue change, - which would have moved the case to Georgetown, Del. or Dover, Del. - should another trial occur.
She has remained in custody at the Baylor Women's Correctional Institute since her December 2004 arrest.
