Staff editorial: The Tobin Case: learning from tragedy

The settlement in the case between the University of Pennsylvania and the parents of alumnus Michael Tobin appears to have been reached professionally and relatively swiftly, to the benefit of both parties. In the wake of such a tragedy, we can do little but learn and take precautions to avoid a similar incident in the future.

It seems clear that the University must do a better job maintaining those Greek houses that, under city law, they are legally obliged to monitor and repair. The Greek system poses a more complicated arrangement between tenant and landlord than regular dormitories, but it seems clear now that the University should take a proactive approach to upkeep of the greek houses they own despite this unusual arrangement.

However, it is also clear that alcohol played a serious and tragic role in Tobin's death. The University has done its best to prevent similar incidents through its alcohol policy and an attempt at stricter regulation of fraternity and sorority parties. But these measures are not and never will be fully effective at preventing future alcohol-related incidents of this kind.

Instead of relying on the University to set boundaries when it comes to drinking, we must take it upon ourselves to exercise good judgment, drink sensibly, or suffer the consequences.

A case with neither a winner nor a loser, the Tobin suit should put both Penn as a corporate entity responsible for facilities maintenance and individuals responsible for themselves on notice. Preventing future tragedies of this sort could be the best way to honor Michael Tobin's life.
