Lawyer: Incident an 'honest mistake'

Sophomore's preliminary hearing on assault charges postponed

An attorney for the Wharton sophomore charged with assaulting a female student in her dormitory room last month called the incident an "honest mistake."

The preliminary hearing in the case of Justin Wynter was rescheduled yesterday morning at the district attorney's request. Wynter is now scheduled to appear in court on Nov. 12.

Wynter's attorney, Ari Moldovsky, said he will attempt to resolve the case at the hearing.

Moldovsky added that Wynter plans to "come back to offer an apology for the misunderstanding."

He also said Wynter is embarrassed about the situation.

"The complainant understands that it was a misunderstanding," Moldovsky said.

Wynter is accused of entering a female student's Harnwell room, where he was a resident, and fondling her at approximately 4:30 a.m. on Sept. 27.

He was arrested after the victim provided police with a physical description that matched Wynter's appearance in surveillance tapes. At an Oct. 1 arraignment, Wynter was charged with burglary, criminal trespass, indecent assault, simple assault, reckless endangerment of another person, unlawful restraint and false imprisonment.

Wynter remains a student of the University, but he no longer resides in a college house, police said last week.

During the brief proceedings yesterday morning, the DA requested the continuance for additional investigation time.

Although Wynter was present in court, the victim did not appear for the scheduled hearing, as the continuation had been expected since Tuesday night.
