Government officials revealed last week that they never received Justice Department approval to file an appeal which has held up Moskovits' new trial for months. Moskovits' attorneys plan to file a motion claiming their client should go free on the grounds that the government's actions have violated Moskovits' right to a speedy trial. In June, U.S. District Court Judge Louis Pollak granted Moskovits a new trial on procedural grounds. That trial was to take place within 70 days, but an appeal by the government has held up the trial for almost five months. Last week, U.S. attorneys withdrew their appeal, admitting they never received approval for it from the Department of Justice's solicitor general, as required. Now Moskovits' lawyers will try to have their client's new trial dismissed on the grounds that he was denied his constitutional and statutory right to a speedy trial, which should have begun within 70 days of Pollak's decision. – JEREMY KAHN
